Licensing applications for a German branch of CRR credit institutions resident in UK (third-country) may already be submitted now for all planned banking activities.
In such a case, when BaFin will grant the license, BaFin will add in its notice the pertinent ancillary provisions that the notice (i.e. the license) will become effective only upon the UK’s exit from the EEA.
For further information refer to BaFin’s “Brexit: FAQs for banks and financial services institutions” and the checklist which contains the documents and information to be handed in for the licensing application. The English version can be found here.
