EU Commission: Evaluation of the EU Dual-Use Regulation launched

Through targeted surveys of various stakeholders, a public consultation, and later an in-depth interview with some of the affected companies, the European Commission will conduct a comprehensive review of the EU Dual-Use Regulation.
Background
The EU Directive (EU) 2021/821 establishes a common authorization obligation and procedural framework for the export, brokering, technical assistance, transit, and transfer of dual-use items across all EU Member States. This directive applies to items that can be used for both civilian and military purposes, such as certain chemicals, machines, technologies, and software, which makes them subject to specific export and control regulations.The competent authority for granting export permits in Germany is the Federal Office for Economic and Export Control (BAFA).
The evaluation process
The review aims to upgrade, modernize and strengthen the EU's export control toolbox and respond effectively to evolving risks and emerging technologies. The proposed Regulation should allow the EU to address the risk of violations of human rights associated with trade in cyber-surveillance technologies without prior agreement at multilateral level. It also enhances the EU's capacity to control trade flows in sensitive new and emerging technologies.
To ensure that the results of the evaluation are as meaningful as possible, a correspondingly high level of participation from Germany—as a major economic hub—is desirable.
The targeted stakeholder surveys for industry, associations, and chambers of commerce, as well as research institutions and universities, have already been made available and can be downloaded here. The answers to these surveys may be submitted until early September 2026.
The public consultation has also started and can be downloaded here. Responses to this more general consultation to be submitted until mid-October 2026.
